What Is A Statutory License?

In the year 2002, the Small Webcaster Settlement Act was passed. This act was made to permit the small web casters in the USA to make use of mainstream music from the Recording Industry Association of America (RIAA) for a flat annual fee of US$500. What does it mean?

The shortest explanation is that small web casters point to niche markets, with audiences that go from 50 to 200 persons. Since these numbers are too small, they argue that they need to make use of certain percentage of mainstream music to maintain their commercial venture viable. But obtaining this statutory license isn't easy. There are some basic requirements that each webcaster should comply with:
Non-Interactive Programming
This means that the webcast cannot offer personalized or on-demand programming. The user will have to conform himself with the music that's been streamed.
Entertainment
The programming should be focused to entertainment, not the promotion of a determined service or product. Let's say that you are still hearing your classical music web casting. You shouldn't be bombarded with advertisement that is focused in an antivirus or a travel agency. The ads need to be diversified.
Sound Recording Performance Complement
It means that the webcaster shall not be able to play in a period of three hours the following things: four or more songs from a determined album, two consecutive songs from the same album, four songs from the same artist, four songs from a boxed set, and three consecutive songs from the same artist or from a boxed set.
